These terms apply to all services provided by Sally Tierney, trading as Yorkshire Garden Designer. By booking a service, you agree to these terms.

Garden consultations

The garden consultation fee is £300 + VAT, payable on booking. The consultation includes a two-hour site visit and a written summary. The fee is non-refundable if cancelled within 48 hours of the agreed visit time. If I need to cancel or reschedule, I will offer an alternative date at no additional cost.

Design packages

Design fees are agreed and confirmed in writing before work begins. A 50% deposit is required to begin work. The remaining balance is due on delivery of the final design drawings. All fees are quoted per project based on the size and complexity of your garden. Fixed-price packages mean no hidden costs.

Revisions

One round of revisions is included in all design packages. Further revisions beyond this are charged at £75 + VAT per hour.

Cancellation

If you wish to cancel a design project after work has begun, the deposit is non-refundable. Any work completed beyond the deposit value will be invoiced at the agreed rate. If I am unable to complete a project for any reason, I will refund the proportion of fees relating to undelivered work.

Intellectual property

All design drawings and documents remain my intellectual property until payment is received in full. On receipt of full payment, you receive a licence to use the drawings for the construction of the designed garden at the specified site only. Drawings may not be reproduced, shared with third parties, or used for any other site without my written permission.

Build supervision

Where build supervision is included, I attend site at agreed intervals to check progress and quality. I am not responsible for the work carried out by your chosen contractor. I am happy to recommend contractors I have worked with, but the contractual relationship for construction work is between you and your contractor.

Limitation of liability

My liability for any claim arising from my services is limited to the total fees paid for the relevant service. I am not liable for the performance or failure of plants, which are living organisms affected by conditions beyond my control. I am not liable for work carried out by third-party contractors. Nothing in these terms limits liability for death or personal injury caused by negligence, or for fraud.

If you are unhappy with any aspect of my service, please contact me at sally@yorkshiregardendesigner.co.uk. I take complaints seriously and will respond within 14 days.

Governing law

These terms are governed by the laws of England and Wales. Any dispute will be subject to the exclusive jurisdiction of the courts of England and Wales.
